This privacy notice does not apply to personal data we process as processors on behalf of our customers. Personal data that you provide us with in connection with applying for a job is subject to our Recruitment Privacy Notice, not to this notice.

Personal data within the meaning of this notice means any information relating to you as an identified or identifiable natural person, and processing means any action performed on personal data.

If the applicable laws require your consent for our processing of personal data related to you, then you indicate your consent when you provide the personal data to us or to any of our service providers, and when you visit, use, attend or opt-in to our Services.

You are not required by law to provide us with any personal data, but if you don’t, you may not use our Services that include processing of personal data related to you.

The following is a summary of our practices. Please take the time to read our full notice. You are under no legal obligation to provide us with personal data related to you. If, after reading this notice, you find that our privacy practices do not align with your views or wishes, you may not use, visit or attend our Services that include processing of personal data related to you.

We collect and use the following personal data related to you:

  • When contacting us via forms on our websites, landing pages and other digital assets, or by emailing us, we will collect personal data related to you, such as your name and email address, phone number, residence, and any personal data that you provide by filling in forms or by emailing us.
  • Any additional personal data related to you that you enter or communicate through our Services.
  • We also automatically collect and process traffic data on how you use our Services to help us improve them, by using cookies and other tracking technologies (see our Cookies and Similar Tracking Technologies Notice for additional information). Such data includes IP addresses, browser information, session durations, viewed pages, mobile ad identifier (or similar unique advertising identifiers), access device and connection information such as browser type, version, and time zone setting, browser plug-in types and versions, operating system, and platform.

  • A merger, acquisition or any other structural change will require us to transfer personal data to another entity as part of the structural change.

Please note that our Services may incorporate services provided by third parties, including Google Calendar appointment scheduling. The terms and conditions governing the privacy practices and processing activities of such services are determined by the third-party services’ respective providers.

How Long Will We Retain Personal Data?

We retain personal data for as long as necessary to fulfill the purposes of using such data under this notice and as permitted by law. Contact information that you provide us is necessary for providing you with service or corresponding with you, but we will delete such data upon your written request.

We will keep aggregated non-identifiable data without limitation. To the greatest reasonable extent, we will endeavor to delete or de-identify potentially identifiable data when we no longer need to process the data in an identifiable form.

Your Choices and Rights

We provide you with the following choices, and respect your rights under the applicable laws, to allow you to control the way we use personal data related to you:

  • At any time, you can stop using any of our Services in accordance with the terms of that Service, and as a result we will stop collecting any respective personal data from you or about you through the Service you stopped using. However, we will store and continue using or making available certain personal data that is related to you. For further information, please read the section “How Long Will We Retain Personal Data?” of this notice.
  • At any time, you may notify us of your refusal to receive our marketing materials by using the “Unsubscribe” or similar link in the marketing messages that we send you and confirm the email address for which you would like to unsubscribe.
  • You have the right to access the personal data that we keep about you, subject to certain applicable legal limitations. We will ask you to provide certain credentials to verify your identity. If required under applicable law, we will make good-faith efforts to locate and provide you with a copy of personal data related to you that you request and that resides in our information systems.
  • If you find that personal data related to you that we process is inaccurate, incomplete or not up to date, you may request that this personal data be corrected or deleted. If we decide to refuse your request, we will notify you of our refusal in accordance with applicable law, and you may appeal our decision.
  • Some web browsers offer a “Do Not Track” (“DNT”) signal. A DNT signal is an HTTP header field indicating your preference for tracking your activities on our Services or through cross-site user tracking. Our online Services do not respond to DNT signals.

Transfer of Personal Data Outside Your Territory

We may store and process personal data in various sites throughout the globe and in sites operated and maintained by cloud-based service providers, including in the United States, and for such purpose transfer personal data related to you to such territories.

Depending on applicable law, such a transfer of personal data is subject to certain conditions. If you are a resident in a jurisdiction where the transfer of personal data related to you to another country requires your consent, then you hereby provide Trigo with the necessary consent for such transfer of personal Data.

We will take all steps reasonably necessary to ensure that personal data related to you is treated securely and in accordance with this notice.

Aggregated and Analytical Data

We may use anonymous, statistical and aggregated data that we derive from personal data related to you to drive insights, statistics, trends and predictions for our internal use and will share it at our discretion for lawful business purposes.

Information Security

We maintain the confidentiality of personal data related to you and we take reasonable steps to ensure that the personal data is accurate, complete, current and reliable for its intended use. We take reasonable measures to protect personal data related to you from loss, misuse and unauthorized access, disclosure, alteration, and destruction.

We do not guarantee that our Services are immune from cyberattacks, malicious activities, malfunctions, honest mistakes or other types of abuse and misuse of personal data.

Changes to this Privacy Notice

From time to time, we will update this notice to reflect changes in relevant laws and regulations, in our Services, information systems and data protection practices. Substantial changes will take effect 7 days after we initially post a notification about them on our website. By continuing to use our Services after the new notice takes effect you indicate your consent to the new notice, if such consent is required by law.

Our Processing of Personal Data under European Economic Area (EEA) Privacy Laws

If EU data protection laws apply to the processing of personal data (the equivalent to information under the General Data Protection Regulation 2016/679 (“GDPR”) and the UK General Data Protection Regulation (“UK GDPR”)) related to you by us, then the following terms apply:

When we process personal data related to you, the processing is based on the following lawful grounds:

  • We will process personal data related to you to comply with a legal obligation and to protect your and others’ vital interests.
  • We will further rely on our legitimate interests, which we believe are not overridden by your fundamental rights and freedoms, for the following purposes:
    • Communication with you, including direct marketing, for example, where you contact us through our Website.
    • Cyber security
    • Support, customer relations, service operations
    • Enhancements and improvements to your and others’ experience with our Services.
    • Fraud detection and misuse of our Services

All processing of personal data related to you that is not based on the lawful grounds indicated above is based on your consent.

Additional Rights Under EEA Privacy Laws

In addition to your rights under other sections in this notice, you are entitled to the following specific rights under the GDPR, as applicable, in relation to personal data:

  • Right to withdraw consent. At any time, contact us if you want to withdraw your consent to the processing of personal data related to you. Exercising this right will not affect the lawfulness of processing based on consent before its withdrawal.
  • Deletion and Restriction Rights. Request to delete or restrict access to personal data related to you. We will review your request and use our discretion, subject to applicable laws, to reach a decision about your request.
  • Portability Right. You may ask to transfer personal data related to you in accordance with your right to data portability.
  • Objection Right. You may object to the processing of personal data related to you for direct marketing purposes or any other processing of personal data related to you which is based on our legitimate interests.
  • Right to lodge a complaint. You have a right to lodge a complaint with a data protection supervisory authority of your habitual residence, place of work or of an alleged infringement of the GDPR.
  • You can obtain a copy of the suitable safeguards that we use when transferring personal data as described below or receive further information about personal data transfer by submitting your request at: privacy-request@trigoretail.com.

If you exercise one (or more) of the above-mentioned rights, in accordance with the provisions of applicable law, you may request to be informed that third parties that hold personal data related to you, in accordance with this notice, will act accordingly.

Note that when you send us a request to exercise your rights, we will need to reasonably authenticate your identity and location. We will ask you to provide us with credentials to make sure that you are who you claim to be, and we will further ask you questions to understand the nature and scope of your request.

If we need to delete personal data related to you following your request, it will take some time until we completely delete residual copies of personal data related to you from our active servers and from our backup systems.

International Transfers

If you are located in EEA, note that we will also transfer personal data from the EEA to countries which provide an adequate level of data protection subject to an EU Commission decision.

If we transfer personal data related to you to jurisdictions which are not deemed to provide an adequate level of data protection, we will use appropriate safeguards, in particular, by way of entering into the European Union (EU) Standard Contractual Clauses (SCCs) and their equivalents under UK laws.

If the U.S. Privacy Laws apply to the processing of personal data related to you by us, then the following terms apply:

As further detailed above, we obtain personal data directly from you, from your use of our Services, from third parties such as event organizers, data providers and publicly available resources.

Sensitive Personal Data

Our Services are not intended to collect sensitive data (within the meaning of U.S. Privacy Laws). We do not knowingly collect or allow others to collect sensitive personal data about you, and we require you not to provide us with any such data.

In the preceding twelve (12) months, we have not used or disclosed sensitive personal data.

Selling and Sharing Personal Data

We do not sell personal data related to you, and do not share it with others for monetary or other valuable consideration or use it for cross-context behavioral advertising. However, we engage third parties to help us market our services, and we may use personal data related to you for targeted advertising purposes. These third parties do not pay us for collecting such data, but the right granted to them to collect personal data may be considered as disclosure for the purpose of selling or sharing for cross-context behavioral advertising.

Subject to the specific privacy law applicable to our processing of personal data about you (such as some U.S. state privacy laws), you may be entitled to opt out of such selling or sharing by contacting us at privacy-request@trigoretail.com or through your “Your Privacy Rights” web page.

The categories of personal data collected by third parties in the preceding twelve (12) months include identifiers, online activities and inferences drawn from such activities. In the preceding twelve (12) months, we have disclosed the categories of personal data as listed above in section “How Do We Share Personal Data Related to You” to this notice, for business purposes.

Children’s Privacy

Our Services are not meant for users under the age of 16. We do not intend and do not knowingly collect, sell or share personal data of children under the age of sixteen (16).

We reserve the right to request proof of age, via a recognized identification method, at any stage so that we can verify that minors are not using our Services without appropriate consent. If we learn that we have collected personal data from children under the age of sixteen (16) we will delete that data promptly.

Additional Rights Under U.S. Privacy Laws

In addition to your rights under other sections in this notice, you are entitled to the following specific rights under the U.S. Privacy Laws, as applicable, in relation to personal data:

  • Right to Know. You have a right to know what personal data we have collected about you. You can request that we disclose certain information to you about our collection and use of personal data over the past 12 months. After verifying your request, we will disclose to you:
    • The categories of personal data we collected about you.
    • The categories of sources for the personal data we collected about you.
    • Our business or commercial purpose for collecting that personal data.
    • The categories of personal data that we disclosed for a business purpose, and the categories of third parties with whom we disclosed that category of personal data.
    • The specific pieces of personal data that we collected about you.
    • If we disclose personal data related to you for a business purpose, we will provide you with a list that will identify the personal data categories that each category of recipient obtained.
  • Deletion. You have the right to request that we delete any personal data related to you. Upon confirmation of your request, we will delete personal data related to you from our records, unless an exception applies.
  • Opt-out of Selling or Sharing. We do not sell personal data related to you to others for monetary consideration. However, we engage third parties to help us market our services and we may use personal data related to you for targeted advertising purposes. U.S. Regulations may consider our disclosure of data to third parties for these purposes as Selling or Sharing of personal data.   • Non-discrimination. You have a right not to be discriminated against for exercising your rights under applicable U.S. Privacy Laws.
  • Limit the Use of Sensitive Personal Data. You have the right to limit the use of sensitive personal data related to specific purposes detailed under applicable U.S. Privacy Laws. Our Services are not intended to collect sensitive data (within the meaning of U.S. Privacy Laws). We do not knowingly collect or allow others to collect sensitive personal data about you, and we require you not to provide us with any such data. We will only receive sensitive personal data about you if you voluntarily choose to provide it, despite our request not to do so. We will handle such data in accordance with applicable U.S. Privacy Laws and the terms of this privacy notice. We may need to verify your identity to process your requests and reserve the right to confirm your residency. To verify your identity, we may require government identification, a declaration under penalty of perjury, or other information, where permitted by law.

Under some U.S. privacy Laws, you may enable an authorized agent to request on your behalf. To verify your authorized agent’s identity and authority to act on your behalf, we may require a copy of a valid power of attorney or provide your agent with written and signed permission to exercise your rights on your behalf as permitted by law.
